About these terms
These Terms and Conditions govern use of the Eco WildRoams website and the safari planning and travel services offered by Eco WildRoams Adventures Limited. A separate quotation, itinerary, invoice or booking confirmation may contain additional terms specific to your trip. Where there is a conflict, the confirmed booking documents will apply to that booking.
Enquiries and quotations
Submitting a website form, safari planner or message is an enquiry only and does not create a confirmed booking. Quotations are personalised and based on the information provided, supplier availability, travel dates, group size, accommodation level, exchange rates, taxes, park fees and transport costs. Unless stated otherwise, a quotation may be revised before confirmation if any of those factors change.
Booking confirmation
A booking is confirmed only after Eco WildRoams confirms availability in writing and receives the required deposit or full payment. The person making the booking confirms that they are authorised to act for all travellers named in the booking and will communicate these terms to them.
Payments and currency
Payment schedules, accepted methods, bank or payment details and currency will be stated in the quotation or invoice. Travellers are responsible for bank, card, transfer or currency-conversion charges unless we state otherwise. Late payment may lead to cancellation or release of supplier reservations.
Cancellations, amendments and refunds
Cancellation and amendment charges depend on notice given and the terms imposed by hotels, camps, airlines, parks, conservancies and other suppliers. Non-refundable deposits or supplier charges may apply. Any refund due will be calculated after deducting applicable cancellation fees, unrecoverable supplier payments and transaction costs. The precise cancellation schedule should be confirmed in the booking documents before payment.
Itinerary and price changes
We may make reasonable changes to routes, accommodation, vehicles, guides or activities where required by availability, safety, weather, road conditions, park rules or circumstances beyond our control. If a significant change occurs before travel, we will explain available alternatives. Additional costs resulting from traveller-requested changes are the traveller’s responsibility.
Passports, visas, health and insurance
Travellers are responsible for valid passports, visas, permits, vaccinations, health requirements and any entry or transit conditions. We strongly recommend comprehensive travel insurance covering medical treatment, evacuation, cancellation, interruption, baggage and activities included in the itinerary. Eco WildRoams does not provide medical or immigration advice.
Wildlife, weather and safari conditions
Wildlife is free-ranging and sightings cannot be guaranteed. Safari travel may involve rough roads, dust, insects, changing weather, remote locations and limited connectivity. By booking, travellers accept the ordinary risks and variable conditions associated with wildlife and outdoor travel.
Traveller conduct and safety
Travellers must follow reasonable instructions from guides, drivers, accommodation providers, park authorities and safety personnel. We may refuse or end participation where conduct threatens safety, disrupts the trip, damages property, harms wildlife or communities, or breaches applicable law. Costs arising from such conduct are the traveller’s responsibility.
Suppliers and third-party services
Eco WildRoams may arrange services provided by independent hotels, camps, airlines, guides, vehicle operators, parks and other suppliers. Those suppliers may apply their own terms and are responsible for the services they directly provide. We select and coordinate suppliers with reasonable care but do not control every act or omission of an independent supplier.
Liability and force majeure
To the extent permitted by law, Eco WildRoams is not liable for loss caused by events outside our reasonable control, including severe weather, natural disasters, disease outbreaks, government action, border restrictions, strikes, road closures, park closures, civil disturbance, flight changes or supplier insolvency. Nothing in these terms excludes liability that cannot lawfully be excluded under Kenyan law.
Website content and intellectual property
Website information is provided in good faith and may change. Unless otherwise stated, the Eco WildRoams name, logo, copy, layout and original website materials are owned by or licensed to Eco WildRoams Adventures Limited. They may not be copied or used commercially without permission. Third-party trademarks and imagery remain the property of their respective owners.
Privacy
Personal information is handled according to our Privacy Policy. By contacting us or booking, you acknowledge that relevant information may be shared with suppliers where necessary to plan and deliver the requested services.
Complaints and dispute resolution
Raise any concern as soon as possible so we have an opportunity to assist. Complaints after travel should be sent in writing with relevant details and supporting documents. We will seek a fair resolution in good faith. These terms are governed by the laws of Kenya, and disputes are subject to the jurisdiction of Kenyan courts unless the parties agree to another lawful dispute-resolution process.
